I. Úvodné ustanovenia
1.1 Občianskeho združenia La Portella, so sídlom Koprivnická 9/E, 841 01 Bratislava, IČO: 51 801 736, zapísaného v registri občianskych združení vedenom Ministerstvom vnútra SR (ďalej len „Podmienky OZ“). Občianske združenie La Portella (ďalej len „OZ“) organizuje výuku v oblasti umenia a latinskoamerických tancov formou tanečných kurzov. Cieľom OZ je podpora a rozvoj tanečného a divadelného umenia, kultúry, kultúrnych a vzdelávacích aktivít so zameraním na deti a mládež ako aj prehlbovanie záujmu o tanečné umenie aj u širokej verejnosti.
1.2 Tieto Podmienky OZ sa vzťahujú na vzťahy, ktoré vzniknú medzi OZ, ktoré je organizátorom výuky tanečných kurzov a záujemcom o jednotlivú výuku tanečných kurzov a to prostredníctvom vyplnenia a odoslania elektronickej prihlášky dostupnej na webovej stránke www.laportella.sk patriacej OZ (ďalej len „prihláška“ alebo „registrácia“).
1.3 Záujemcom je každá osoba (fyzická alebo právnická), ktorá vyplnila a odoslala prihlášku
prostredníctvom webovej stránky OZ, obdržala emailové oznámenie o prijatí prihlášky a registrácie a uhradila príspevok na činnosť OZ.
II. Prihláška / Registrácia záujemcu
2.1 Záujemca o tanečnéhý kurzu vyplnením požadovaných informácií o účastníkovi zvoleného tanečného kurzu a prejavom súhlasu s podmienkami OZ (dostupné na: www.laportella.sk) a prejavom súhlasu so spracovaním osobných údajov v rozsahu a za účelom potrebným pre registráciu a kliknutím na tlačidlo „odoslať“ odosiela OZ prihlášku so záujmom o zvolený tanečný kurzu (ďalej len „prihláška“).
2.2 Vyplnením elektronickej prihlášky (ďalej len „prihláška“) a potvrdením oboznámenia sa s týmito podmienkami OZ, záujemca súhlasí s podmienkami OZ. Podmienky OZ tvoria súčasť každej prihlášky a sú stále prístupné na webovej stránke OZ.
2.3 Potvrdením prijatia prihlášky záujemcu o tanečnéný kurz zo strany OZ a to elektronicky formou zaslania emailu na adresu záujemcu, sa stáva prihláška záväznou a záujemca je registrovaný v zozname účastníkov tanečného kurzu. Záväzná prihláška obsahuje informácie o účastníkovi a zoznam zvolených služieb ku konkrétnemu tanečnému kurzu, ktoré záujemca o výuku tanečného kurzu v prihláške uviedol. Na základe prijatia a potvrdenia prihlášky zo strany OZ sa pre záujemcu vygeneruje aicky platobný doklad na úhradu príspevku na činnosť OZ pre objednaný tanečný kurz.
2.4 Registrácia účastníka je na dobu určitú. Zaniká ukončením výuky zvoleného tanečného kurzu.
2.5 V prípade prihlášky a následnej registrácie pre zvolený tanečný kurz v prospech tretej osoby je táto osoba (účastník) viazaná záväznou prihláškou a podmienkami OZ momentom prejavenia súhlasu s objednaným tanečným kurzom.
III. Príspevok na činnosť a organizáciu OZ a platobné podmienky
3.1 Príspevok na činnosť OZ pre organizovanie každého tanečného kurzu je uvedený v zozname príspevkov platnom v čase podania prihlášky a je stanovený OZ, pokiaľ nie je s OZ dohodnuté inak. Konkrétna výška príspevku na činnosť OZ pre vybraný tanečný kurz je uvedená na webovej stránke. Po úhrade príspevku na činnosť OZ, OZ zašle záujemcovi potvrdzujúci mail o prijatí príspevku na činnosť OZ vrátane potvrdenia o prijatí príspevku na činnosť OZ.
3.2 Pre vylúčenie akýchkoľvek pochybností, výška príspevku na činnosť OZ vygenerovaná v prípade konkrétnej prihlášky sa po jeho úhrade v lehote splatnosti už nemení.
3.3 Príspevok na činnosť OZ pre zvolený tanečný kurz je splatný ihneď, alebo najneskôr do 2 dní od potvrdenia prijatia prihlášky a registrácie. Príspevok na činnosť OZ pre tanečný kurz zvolený osobne v deň začatia prvej vyučovacej hodiny tanečného kurzu je splatný ihneď od začatia prvej vyučovacej hodiny tanečného kurzu a v prípade okamžitého nástupu účastníka v deň začatia prvej vyučovacej hodiny tanečného kurzu je príspevok na činnosť OZ splatný okamžite. Príspevok na činnosť OZ pre tanečný kurz „Open Class“ je splatný okamžite.
3.4 Záujemca je povinný uhradiť príspevok na činnosť OZ pre zvolený tanečný v rozsahu a v lehote uvedenej v potvrdení o prijatí prihlášky. Príspevok na činnosť OZ za zvolený tanečný kurz je možné uhradiť prevodom na účet OZ. V prípade úhrady príspevku na činnosť OZ
prevodom na účet sa príspevok považuje za uhradený dňom pripísania peňažných prostriedkov na účet OZ.
3.5 Príspevok na činnosť OZ súvisiacu s organizáciou a realizáciou jednotlivých tanečných kurzov je nevratným príspevkom a platí sa kontinuálne až po dátum písomného odhlásenia prostredníctvom e-mailu.
IV. Príspevok na činnosť OZ a platobné podmienky za organizáciu letného tábora
4.1 OZ organizuje a realizuje svoju činnosť aj formou dennej starostlivosti v rámci denného týždenného tábora v čase od 8:00 hod. do 16:00 hod (s odchodom do 16:30)
4.2 Príspevok na činnosť OZ za realizáciu letného tábora La Portella je stanovený na webovej stránke www.laportella.sk
4.3 Záujemca je povinný uhradiť príspevok na činnosť OZ spojený s realizáciou zvoleného letného tábora v lehote splatnosti. Minimálne 50% príspevku na činnosť OZ spojený s realizáciou zvoleného letného tábora je splatný do 7 (sedem) dní od potvrdenia prihlášky. V prípade, že prihláška nebola minimálne z 50% uhradená do 7 (sedem) dní od vytvorenia prihlášky, prihláška bude aicky vymazaná. Plná suma musí byť splatná najneskôr 10 (desať) dní pred začatím zvoleného letného tábora.
4.4 Príspevok na činnosť OZ spojený s realizáciou zvoleného letného tábora môže záujemca uhradiť platobnou kartou alebo prevodom na účet OZ. V prípade úhrady príspevku na činnosť OZ spojený s realizáciou zvoleného letného tábora prevodom na účet sa príspevok považuje za uhradený dňom pripísania peňažných prostriedkov na účet OZ.
4.5 Záujemca môže požiadať OZ o zrušenie registrácie pre letný tábor. V prípade zrušenia registrácie zo strany záujemcu, môže záujemca požiadať o vrátenie zaplateného príspevku na činnosť OZ v nasledovnom rozsahu:
– 50 % (prvá splátka) z príspevku na činnosť OZ spojenú s realizáciou letného tábora je nevratná
– v prípade zrušenia registrácie zo strany záujemcu v lehote kratšej ako jeden týždeň pred začatím letného tábora alebo počas trvania letného tábora, záujemca nárok na vrátenie zaplateného príspevku na činnosť OZ nemá.
– žiadosť o zrušenie registrácie je záujemca povinný zaslať OZ a to písomne elektronicky na
mailovú adresu OZ laportellask@gmail.com
– v prípade zrušenia termínu zo strany záujemcu pred nástupom z dôvodu ochorenia mu bude po doložení potvrdenia od lekára príspevok vrátený, alebo ponúknutý iný termín, alebo je možné termín presunúť na náhradníka.
V. Práva a povinnosti
5.1 OZ:
• je oprávnené zmeniť miesto a termín konania tanečného kurzu, osobu lektora toho-ktorého tanečného kurzu ako aj program tanečného kurzu.
• je povinné pri zmene programu tanečného kurzu zachovať základný rozsah, parametre
pôvodného tanečného kurzu a pôvodný počet hodín tanečného kurzu.
• je povinné o zmene programu a zmene termínu konania tanečného kurzu informovať účastníka tanečného kurzu aspoň tri 1 (jeden) deň vopred.
5.2 Záujemca:
• je povinný uhradiť príspevok na činnosť OZ za zvolený tanečný kurz riadne a včas a kontinuálne až po dobu odhlásenia sa z TŠ La Portella.
5.3 Účastník:
• Účastník je povinný riadiť sa pokynmi organizátora alebo jeho zástupcu, alebo iných osôb
poskytujúcich služby v mene OZ
• Účastník je povinný dodržiavať a riadiť sa prevádzkovým poriadkom
• Účastník nesmie rušiť riadny priebeh tanečného kurzu, najmä svojim správaním nadmieru
obťažovať ostatných účastníkov kurzu
• Účastník je povinný dodržiavať zásady hygieny a slušného správania
• Účastník je povinný dbať o svoje zdravie a zdravie ostatných účastníkov tanečného kurzu a ak by pokračovanie účastníka v tanečnom kurze ohrozovalo ostatných účastníkov kurzu, je povinný to bezodkladne oznámiť
• Účastník mladší ako 18 rokov sa môže zúčastniť tanečného kurzu len so súhlasom zákonného zástupcu
• Účastník, ktorý sa nemôže zúčastniť tanečného kurzu v zmenenom termíne, má nárok na
nahradenie hodiny tanečného kurzu na určenej hodine tanečného kurzu vo vopred dohodnutom termíne. Vymeškané hodiny nie sú finančne kompenzované. Účastník, ktorý vymešká tanečnú hodinu má nárok na jeho náhradu v čase náhradných hodín iba ak je aktívnym členom TŠ La Portella a má aktuálne uhradený členský príspevok.
• náhradné hodiny prebiehajú každý piatok v tanečnej sále v Ružinove ( náhradné hodiny neprebiehajú počas dní pon-štv. na iných lokalitách)
• skúšobnou hodinou sa rozumie prvá tanečná hodina, ktorú účastník absolvuje na tanečnom krúžku. Ak účastník odmietne kurz po absolvovaní prvej lekcie, bude mu vrátená celá suma kurzu okrem zápisného poplatku, ktorú poukázal na účet OZ La Portella. Zápisný poplatok účastníkovi vrátený NIE je. Ak účastník zruší kurz po druhej a viac lekciách, bude mu vrátená alikvotná čiastka nevyčerpaných lekcií. Zápisný poplatok účastníkovi vrátený NIE je.
5.4 Člen súťažného tímu:
• Členovia súťažnej kategórie, ktorí sa zúčastňujú súťaží alebo vystúpení, hradia náklady na kostýmy z vlastných finančných prostriedkov. Za týmto účelom je možné využiť 2 % z daní, dary alebo sponzoring.
VI. Doba trvania registrácie, zánik registrácie
6.1 Registrácia záujemcu a účastníka je na dobu určitú a to na dobu trvania zvoleného tanečného kurzu. Skončením tanečného kurzu registrácia zaniká.
6.2 Registrácia záujemcu a účastníka je dobrovoľná. Záujemca alebo účastník môže kedykoľvek požiadať OZ o zrušenie registrácie a to písomnou žiadosťou zaslanou elektronicky na mailovú adresu OZ laportellask@gmail.com.
6.3 OZ je oprávnené okamžite ukončiť registráciu záujemcu o zvolený tanečný kurz v prípade, ak mu okolnosti neumožňujú realizovať tanečný kurz v rozsahu a termíne, prípadne ani v náhradnom termíne.
V takom prípade má záujemca nárok na vrátenie zaplateného príspevku na činnosť OZ alebo jeho časti nevyčerpanej časti tanečného kurzu, po odpočítaní zápisného príspevku vo výške 25,- EUR, ktorý sa nevracia a administratívny poplatok za predčasné ukončenie členstva vo výške 25 eur.
6.6 OZ je oprávnené okamžite ukončiť registráciu záujemcu o zvolený tanečný kurz z dôvodu hrubého porušenia povinností účastníka uvedených v článku V. V takom prípade sa zaplatený príspevok na činnosť OZ ani registračný poplatok vo výške 25,- EUR sa nevracia.

VII. Zodpovednosť za škodu.
7.1 Účastník tanečného kurzu zodpovedá za škodu, ktorú spôsobí OZ. Zodpovednosti za spôsobenú škodu sa účastník zbaví, ak preukáže, že škodu nespôsobil.
7.2 OZ zodpovedá za škodu spôsobenú úmyselne alebo z nedbanlivosti zástupcom OZ účastníkovi.
7.3 OZ nezodpovedá za škodu na zdraví alebo majetku účastníka kurzu, ktorú si účastník kurzu spôsobí úmyselne, z nedbanlivosti, prípadne neopatrnosti sám.
7.4 OZ nezodpovedá za škodu na zdraví alebo majetku účastníka kurzu, ktoré účastníkovi kurzu vzniknú následkom nedodržania pokynov OZ alebo jeho zástupcu.
7.5 Zákonný zástupca alebo doprovod neplnoletého účastníka tanečného kurzu zodpovedá za škodu spôsobenú neplnoletým účastníkom tanečného kurzu až do chvíle ako neplnoletého účastníka tanečného kurzu prevezme pri vstupe do sály lektor tanečného kurzu. Po ukončení lekcie preberá zodpovednosť za neplnoletého účastníka tanečného kurzu zákonný zástupca alebo doprovod neplnoletého účastníka tanečného kurzu. Pokiaľ sa neplnoletý účastník tanečného kurzu zúčastní lekcie bez doprovodu, poskytovateľ nepreberá zodpovednosť za škodu spôsobenú neplnoletým účastníkom tanečného kurzu pred a po kurze.
VIII. Ochrana osobných údajov a súkromia
8.1 OZ plne rešpektuje dôvernosť údajov záujemcu a účastníka, ktoré vypĺňa záujemca do prihlášky a poskytuje OZ. Všetky údaje sú zabezpečené a chránené proti zneužitiu. OZ prehlasuje, že poskytnuté údaje použije výlučne k realizácii objednaného tanečného kurzu podľa prihlášky, k vykonaniu potrebných
účtovných operácií, k identifikácii bezhotovostných platieb a na komunikáciu so záujemcom, prípadne na marketingové účely. Údaje poskytnuté záujemcom sú ukladané v informačnom systéme OZ, ktorý je zabezpečený proti zneužitiu.
IX. Všeobecné pravidlá účasti a konania tanečných kurzov
9.1 Termíny a čas konania jednotlivých tanečných kurzov sa riadia rozvrhom určeným pred začiatkom kurzu. Rozvrh je priebežne aktualizovaný OZ. Aktuálne informácie sú zverejnené na webovej stránke OZ dostupnej na adrese www.laportella.sk a vyvesené v priestoroch OZ. Účastník tanečného kurzu je povinný tieto informácie priebežne sledovať a s prípadnými zmenami sa v čas oboznámiť a zobrať informácie na vedomie.
9.2 V prípade doručenia prihlášky na tanečný kurz, ktorý úž prebieha, si OZ vyhradzuje právo, na základe vlastného uváženia a po zohľadnení obsadenosti a počtu voľných miest, rozhodnúť o zaradení účastníka do už prebiehajúceho tanečného kurzu. V prípade zaradenia účastníka tanečného kurzu do už prebiehajúceho tanečného kurzu je záujemca alebo účastník tanečného kurzu povinný uhradiť príspevok na činnosť OZ za zvolený tanečný kurz, vo výške zodpovedajúcej počtu kalendárnych mesiacov, ktorých sa účastník tanečného kurzu má zúčastniť. Účastníkovi však nárok na zaradenie do už prebiehajúceho
tanečného kurzu aicky odoslaním prihlášky nevzniká.
9.3 OZ si vyhradzuje právo zmeny tanečného lektora iným lektorom s rovnakou kvalifikáciou.
V prípade, že OZ pred začatím lekcie tanečného kurzu nedokáže zabezpečiť iného lektora s rovnakou kvalifikáciou, OZ si vyhradzuje právo danú lekciu tanečného kurzu zrušiť. V takom prípade je OZ povinné informovať účastníka tanečného kurzu o náhradnom termíne konania lekcie tanečného kurzu. Účastník tanečného kurzu, ktorý sa nemôže zúčastniť náhradného termínu konania lekcie tanečného kurzu, nemá nárok na vrátenie alikvotnej časti príspevku za danú lekciu tanečného kurzu.
9.4 Účastník tanečného kurzu má nárok na náhradu zmeškaných lekcií tanečného
kurzu počas jedného obdobia.
X. Záverečné ustanovenia
10.1 Tieto Podmienky OZ platia v znení v akom boli schválené príslušným orgánom OZ a v znení v akom sú uverejnené na internetovej stránke OZ.
10.2 OZ je oprávnené tieto Podmienky podľa potreby kedykoľvek zmeniť. Nové znenie Podmienok nadobudne účinnosť dňom ich zverejnenia na webovej stránke OZ dostupnej na webovej adrese www.laportella.sk.
10.3 Pre účastníkov tanečného kurzu sú záväzné Podmienky OZ účinné v deň zaslania prihlášky. V prípade, že dôjde k zmene Podmienok OZ po zaslaní prihlášky záujemcom, táto zmena nebude mať vplyv na práva a povinnosti strán. Záujemca ma právo pristúpiť k novým Podmienkam OZ.
Znenie Podmienok OZ je účinné od 01.08.2022
I. Introductory provisions
1.1 Civic association La Portella, with registered office at Koprivnická 9/E, 841 01 Bratislava, IČO: 51 801 736, registered in the register of civil associations maintained by the Ministry of the Interior of the Slovak Republic (hereinafter referred to as „Conditions of the Association“). The civic association La Portella (hereinafter referred to as „OZ“) organizes teaching in the field of art and Latin American dances in the form of dance courses. The goal of OZ is the support and development of dance and theatre art, culture, cultural and educational activities with a focus on children and youth, as well as deepening interest in dance art among the general public.
1.2 These Terms and Conditions of the OZ apply to relations that arise between the OZ, which is the organizer of dance courses, and an individual interested in dance courses by filling in and sending the electronic application form available on the website www.laportella.sk belonging to the OZ (hereinafter referred to as “ application‘ or ‚registration‘).
1.3 Any person (individual or legal entity) who filled out and sent the application is an interested party through the OZ website, received an email notification of acceptance of the application and registration and paid a contribution to the activities of the OZ.
II. Application / Registration of an interested party
2.1 Those interested in a dance course by filling in the required information about the participant of the chosen dance course and expressing their agreement with the terms and conditions (available at: www.laportella.sk) and expressing their agreement with the processing of personal data to the extent and for the purpose necessary for registration and clicking on the „send“ button OZ sends an application with interest in the chosen dance course (hereinafter referred to as the „application“).
2.2 By completing the electronic application (hereinafter referred to as the „application“) and confirming familiarity with these terms and conditions, the interested party agrees to the terms and conditions of the Terms and Conditions. The terms and conditions of the OZ form part of every application and are still accessible on the OZ website.
2.3 By confirming the acceptance of the applicant’s application for a dance course by OZ electronically by sending an email to the applicant’s address, the application becomes binding and the applicant is registered in the list of participants of the dance course. The binding application contains information about the participant and a list of selected services for a specific dance course, which the person interested in taking a dance course stated in the application. Based on the acceptance and confirmation of the application by the Association, a payment document will be aically generated for the applicant to pay the contribution for the activity of the Association for the ordered dance course.
2.4 Participant registration is for a certain period of time. It expires upon completion of the chosen dance course.
2.5 In the case of application and subsequent registration for the selected dance course for the benefit of a third party, this person (participant) is bound by the binding application and the terms of the GTC at the moment of expressing consent to the ordered dance course.
III. Contribution to the activity and organization of the OZ and payment terms
3.1 Contribution to the activities of the OZ for the organization of each dance course is listed in the list of contributions valid at the time of application and is determined by the OZ, unless otherwise agreed with the OZ. The specific amount of the contribution to the activity of the OZ for the selected dance course is indicated on the website. After payment of the contribution for the activity of the OZ, the OZ will send the interested party a confirmation email about the receipt of the contribution for the activity of the OZ, including confirmation of the receipt of the contribution for the activity of the OZ.
3.2 For the avoidance of any doubt, the amount of the contribution to the activity of the OZ generated in the case of a specific application does not change after its payment within the due date.
3.3 The contribution to the activity of the OZ for the selected dance course is payable immediately, or at the latest within 2 days from the confirmation of receipt of the application and registration. The contribution to the OZ activity for the dance course chosen in person on the day of the start of the first lesson of the dance course is payable immediately after the start of the first lesson of the dance course, and in the case of the participant’s immediate start on the day of the start of the first lesson of the dance course, the contribution to the OZ activity is payable immediately. The contribution to the OZ activity for the „Open Class“ dance course is payable immediately.
3.4 The interested party is obliged to pay a contribution to the activity of the OZ for the chosen dance within the scope and within the deadline specified in the confirmation of receipt of the application. The contribution to the activity of the OZ for the selected dance course can be paid by transfer to the account of the OZ. In the case of payment of a contribution to the activity of the Association
by transfer to the account, the contribution is considered paid on the day the funds are credited to the OZ account.
3.5 The contribution to the activity of the OZ related to the organization and implementation of individual dance courses is a non-refundable contribution and is paid continuously until the date of written cancellation via e-mail.
V. Contribution to the activity of the OZ and payment conditions for the organization of the summer camp
4.1 The OZ organizes and implements its activities also in the form of day care within the daily weekly camp from 8:00 a.m. until 4:00 p.m. (with departure until 4:30 p.m.)
4.2 The contribution to the activities of the Association for the implementation of the La Portella summer camp is determined on the website www.laportella.sk
4.3 The interested party is obliged to pay the contribution to the activity of the association connected with the implementation of the selected summer camp by the due date. At least 50% of the contribution to the activities of the OZ associated with the implementation of the selected summer camp is payable within 7 (seven) days from the confirmation of the application. In the event that at least 50% of the application has not been paid within 7 (seven) days from the creation of the application, the application will be aically deleted. The full amount must be paid no later than 10 (ten) days before the start of the selected summer camp.
4.4 The interested party can pay the contribution to the activity of the association connected with the implementation of the selected summer camp by payment card or transfer to the account of the association. In the case of payment of a contribution to the activity of the OZ connected with the implementation of the selected summer camp by transfer to the account, the contribution is considered to have been paid on the day the funds are credited to the account of the OZ.
4.5 The interested party can request the OZ to cancel the registration for the summer camp. In case of cancellation of the registration by the interested party, the interested party may request a refund of the paid contribution for the activities of the Association in the following scope:
– 50% (first instalment) of the contribution to the OZ activity connected with the implementation of the summer camp is non-refundable
– in case of cancellation of the registration by the interested party less than one week before the start of the summer camp or during the duration of the summer camp, the interested party is not entitled to a refund of the paid contribution for the activities of the OZ.
– the interested party must send a request for cancellation of registration to the OZ in writing electronically to
email address OZ laportellask@gmail.com
– in case of cancellation of the date by the interested party before the start due to illness, the contribution will be refunded, or another date will be offered, or the date can be transferred to a substitute.
V. Rights and obligations
5.1 OZ:
• it is authorized to change the place and date of the dance course, the person of the lecturer of the dance course as well as the program of the dance course.
• it is mandatory to maintain the basic scope and parameters when changing the dance course program
of the original dance course and the original number of hours of the dance course.
• it is mandatory to inform the participant of the dance course at least three 1 (one) days in advance about the change of the program and the date of the dance course.
5.2 Interested party:
• is obliged to pay the contribution to the activity of the OZ for the chosen dance course properly and on time and continuously until the time of deregistration from TŠ La Portella.
5.3 Participant:
• The participant is obliged to follow the instructions of the organizer or his representative or other persons
providing services on behalf of OZ
• The participant is obliged to observe and follow the operating rules
• The participant must not disrupt the proper course of the dance course, especially by excessive behavior
harass other course participants
• The participant is obliged to observe the principles of hygiene and decent behavior
• The participant is obliged to take care of his health and the health of the other participants of the dance course, and if the participant’s continuation in the dance course would endanger the other participants of the course, he is obliged to report this immediately
• A participant under 18 years of age can only take part in a dance course with the consent of a legal representative
• A participant who cannot attend a dance course on a changed date is entitled to
replacing a dance course lesson at a designated dance course lesson on a pre-arranged date. Missed hours are not financially compensated. A participant who misses a dance class is entitled to a replacement during the replacement class only if he is an active member of TŠ La Portella and has currently paid his membership fee.
• replacement classes take place every Friday in the dance hall in Ružinov (replacement classes do not take place on Monday-Thursday at other locations)
• trial lesson means the first dance lesson that the participant completes on the dance floor. If the participant refuses the course after completing the first lesson, the entire amount of the course will be returned to him, except for the registration fee, which he transferred to the OZ La Portella account. The registration fee is NOT refunded to the participant. If the participant cancels the course after the second or more lessons, the aliquot amount of unused lessons will be refunded. The registration fee is NOT refunded to the participant.
5.4 Member of the competition team:
• Members of the competition category who participate in competitions or performances cover the cost of costumes from their own funds. For this purpose, it is possible to use 2% of taxes, donations or sponsorship.
VI. Duration of registration, termination of registration
6.1 The registration of the interested party and the participant is for a certain period of time, for the duration of the chosen dance course. Upon completion of the dance course, the registration expires.
6.2 Registration of interested parties and participants is voluntary. An interested party or a participant can request OZ to cancel the registration at any time by a written request sent electronically to the email address OZ laportellask@gmail.com.
6.3 OZ is entitled to immediately terminate the registration of a person interested in the chosen dance course if the circumstances do not allow him to implement the dance course in the scope and date, or even in an alternative date.
In such a case, the applicant is entitled to a refund of the paid contribution for the activities of the OZ or its part of the unused part of the dance course, after deducting the non-refundable registration fee of EUR 25 and the administrative fee for premature termination of membership in the amount of EUR 25.
6.6 The OZ is entitled to immediately terminate the registration of an applicant for the chosen dance course due to a gross violation of the participant’s obligations listed in Article V. In such a case, the paid contribution to the activity of the OZ or the registration fee of EUR 25 will not be refunded.

VII. Liability for damage.
7.1 The participant of the dance course is responsible for the damage caused by OZ. The participant is released from responsibility for the damage caused if he proves that he did not cause the damage.
7.2 OZ is responsible for damage caused intentionally or through negligence by a representative of OZ to the participant.
7.3 OZ is not responsible for damage to the health or property of the course participant, which the course participant causes himself/herself intentionally, due to negligence or imprudence.
7.4 OZ is not responsible for damage to the health or property of the course participant, which occurs to the course participant as a result of failure to follow the instructions of OZ or its representative.
7.5 The legal representative or accompanying person of the minor dance course participant is responsible for the damage caused by the minor dance course participant until the moment when the minor dance course participant is taken over by the dance course instructor upon entering the hall. After the end of the lesson, the legal representative or escort of the minor participant of the dance course assumes responsibility for the minor participant of the dance course. If the minor participant of the dance course attends the lesson unaccompanied, the provider does not assume responsibility for the damage caused by the minor participant of the dance course before and after the course.
VIII. Protection of personal data and privacy
8.1 OZ fully respects the confidentiality of the applicant’s and participant’s data, which the applicant fills in the application form and provides to OZ. All data is secured and protected against misuse. OZ declares that it will use the provided data exclusively to implement the ordered dance course according to the application form, to carry out the necessary
accounting operations, to identify non-cash payments and to communicate with interested parties, or for marketing purposes. The data provided by the interested parties are stored in the information system of OZ, which is secured against misuse.
IX. General rules for participation and conduct of dance courses
9.1 The dates and times of individual dance courses are governed by the schedule determined before the start of the course. The schedule is continuously updated by OZ. Current information is published on the OZ website available at www.laportella.sk and posted in the OZ premises. The participant of the dance course is obliged to continuously monitor this information and to familiarize himself with any changes in time and take note of the information.
9.2 In the case of delivery of an application for a dance course that is already in progress, OZ reserves the right, based on its own discretion and after taking into account occupancy and the number of free places, to decide on the inclusion of the participant in an already ongoing dance course. In the case of enrolling a dance course participant in an already ongoing dance course, the applicant or dance course participant is obliged to pay a contribution to the activities of the Association for the chosen dance course, in the amount corresponding to the number of calendar months in which the dance course participant is to participate. However, the participant is entitled to be included in the already ongoing one

9.3 OZ reserves the right to change the dance instructor to another instructor with the same qualifications.
In the event that OZ is unable to secure another teacher with the same qualifications before the start of the dance course lesson, OZ reserves the right to cancel the given dance course lesson. In such a case, OZ is obliged to inform the participant of the dance course about the alternative date of the dance course lesson. A dance course participant who cannot attend the alternative date of the dance course lesson is not entitled to a refund of the aliquot part of the contribution for the given dance course lesson.
9.4 The participant of the dance course is entitled to compensation for missed dance lessons
course during one period.
X. Final Provisions
10.1 These OZ Terms and Conditions apply in the wording in which they were approved by the relevant body of the OZ and in the wording in which they are published on the website of the OZ.
10.2 OZ is entitled to change these Conditions at any time as necessary. The new wording of the Terms and Conditions will enter into force on the day of their publication on the OZ website available at the website address www.laportella.sk.
10.3 For dance course participants, the binding Terms and Conditions are effective on the day the application is sent. In the event that there is a change in the Terms and Conditions after the application has been sent to interested parties, this change will not affect the rights and obligations of the parties. The interested party has the right to accede to the new Terms and Conditions.
